So our patent portfolio is so much stronger than it was not only because of the Microsoft rejections from the PTO, not only because of the new patents in VoIP and presence but also because the financial condition of the firm means we are no longer in a rush to find some form of funding.&lt;BR/&gt;&lt;BR/&gt;&lt;BR/&gt;Re our friends at Microsoft - As you&lt;BR/&gt; recall most of Microsoft's re-exam requests were rejected by the PTO as without merit; we continue to talk with them but we are in no rush now. Enforcement of these rules is scheduled to resume on Monday, April 20, 2009".   Although this does not directly effect us, as our issue with Nasdaq's listing criteria relates to the $35M market cap rule (which for Avistar means a stock price at $1.02.. effectively the same price position as the "waived" dollar bid price), it does highlight that many good companies are being adversely impacted by the volatility/collapse of the overall equity market.  &lt;BR/&gt; &lt;BR/&gt;&lt;BR/&gt;Having said that, we are not going to be distracted.. doing the right things in our business (which we believe we are doing, and we believe our sequential performance confirms) is also the right set of activities for shareholder value and our Nasdaq position.  Our, my job, is to fix the company and we are making great progress. I agree with Tom Seibal when he said - the stock price will look after itself. We will continue to share our progress with the market but if there's no one listening we will not change strategy simply to push up a stock price. So we are focusing at building a successful, profitable company that staff and shareholders want to be involved with. And we are making great progress with this - I genuinely feel we are out of the woods in addressing and solving the very difficult challenges that this management team inherited in January.
